1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Room Enhance AI ("we," "us," or "our"), concerning your access to and use of the Room Enhance AI website and services.

By accessing or using our service, you agree to be bound by these Terms of Use. If you disagree with any part of the terms, you may not access the service.

2. Description of Service

Room Enhance AI is an artificial intelligence-powered service that transforms room photographs according to user-provided prompts and instructions. The service includes room visualization, furniture placement, and other interior design transformation features.

We reserve the right to withdraw or amend our service, and any service or material we provide, in our sole discretion without notice. We will not be liable if for any reason all or any part of the service is unavailable at any time or for any period.

3. User Accounts

To access certain features of the service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for:

• Maintaining the confidentiality of your account and password
• Restricting access to your computer or device
• All activities that occur under your account

You agree to notify us immediately of any unauthorized access to or use of your account. We reserve the right to disable any user account at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.

4. Payment and Credits

Some aspects of our service may require payment in the form of purchasing credits. By purchasing credits, you agree to pay all fees and applicable taxes in a timely manner with a valid payment method. All payments are non-refundable except as required by law.

We reserve the right to change our prices at any time. If we do change prices, we will provide notice of the change on the site or by email, at our option, at least 14 days before the change takes effect.

Credits purchased on our platform never expire, allowing you to use them at your convenience without time constraints.

5. User Content

"User Content" refers to all information and content that a user submits to the service, including but not limited to photographs, prompts, descriptions, and other materials.

By providing User Content to the service, you:

• Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of providing and improving our service
• Represent and warrant that you own or have the necessary rights to the User Content and that the User Content does not violate the rights of any third party
• Acknowledge that we may use your User Content to train and improve our AI models

6. Prohibited Uses

You may use the service only for lawful purposes and in accordance with these Terms of Use. You agree not to use the service:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
• To generate images of real people without their consent
• To generate content that is harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or otherwise objectionable
• To impersonate or attempt to impersonate another person or entity
• To interfere with or disrupt the service or servers or networks connected to the service
• To attempt to gain unauthorized access to parts of the service, other accounts, or computer systems or networks connected to the service

7. Intellectual Property Rights

The service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Room Enhance AI and its licensors. The service is protected by copyright, trademark, and other laws of the United States and foreign countries.

With respect to generated images created by our AI service:

• You will own the rights to use the specific images generated for you based on your inputs
• We retain the right to use your inputs and the AI-generated outputs to improve our models and services
• You may not claim copyright or other intellectual property rights to the underlying AI technology that created the images

8. Limitation of Liability

In no event will Room Enhance AI, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the service, any websites linked to it, any content on the service or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

9. Indemnification

You agree to defend, indemnify, and hold harmless Room Enhance AI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the service.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the service shall be instituted exclusively in the federal courts of the United States or the courts of the State of California.

11. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the service after any such changes constitutes your acceptance of the new Terms. You are expected to check this page frequently to be aware of any changes, as they are binding on you.
